Capital gains tax is levied on profits from selling investments like stocks, bonds, cryptocurrency, real estate, and other assets. The tax rate depends on how long you held the asset and your income level.

Short-term gains (held <1 year) are taxed at ordinary income rates (10-37% federally). Long-term gains (held 1+ years) get preferential rates of 0%, 15%, or 20% federally.

On top of federal tax, most states also tax capital gains. 8 states have no income tax at all, making them the most tax-friendly for investors. States like California (13.3%), New Jersey (10.75%), and New York (10.9%) have the highest combined rates.

The Net Investment Income Tax (NIIT) adds 3.8% for high earners (AGI above $200K single / $250K married), bringing the maximum federal rate to 23.8%.
